These terms govern your use of this website and any evaluation access to the Automentic platform. Production use of the platform is governed by a separate written agreement; where that agreement conflicts with these terms, the agreement prevails.
1. Who these terms are with
This website is operated by Metroelectric – Electricians & Engineers Pty Ltd, registered at 26 Saint Georges Terrace, International House, Ground Floor, Perth, WA 6000, Australia (“Automentic”, “we”, “us”). By using the site you agree to these terms. If you do not agree, please do not use the site.
2. The website
We provide this site for information about our products. We may change, suspend or withdraw any part of it at any time. We do not guarantee uninterrupted availability, and we may restrict access to some areas.
3. Evaluation and demo access
Any demo, trial or evaluation access is provided for assessment only, is time-limited, and may be withdrawn at our discretion. It is provided without warranty. Do not process live production data, regulated data, or personal data of third parties in an evaluation environment unless we have signed a Data Processing Agreement covering it.
4. Acceptable use
You agree not to: use the site or any evaluation access unlawfully; attempt to gain unauthorised access to any system, account or data; probe, scan or test the vulnerability of our infrastructure without prior written permission; interfere with availability, including by automated or excessive requests; reverse engineer, copy or resell any part of the service except where that restriction is prohibited by law; or submit content that is unlawful, infringing or malicious.
We welcome good-faith security research. Contact us first at security@automentic.com and follow any coordinated disclosure process we provide.
5. Intellectual property
The site, the Automentic platform, and all associated software, text, design, trade marks and documentation remain our property or that of our licensors. Nothing here transfers any right to you beyond the limited permission to view the site and to use evaluation access as intended.
Any feedback you send us may be used freely, without obligation to you.
6. Your content
You keep ownership of anything you submit through our forms. You grant us permission to use it for the purpose you submitted it — responding to your enquiry — as described in our Privacy Policy.
7. Third-party links
Where we link to third-party sites or standards documentation, we do so for convenience. We do not control and are not responsible for their content or practices.
8. Disclaimers
The site and any evaluation access are provided “as is” and “as available”. To the fullest extent permitted by law we exclude all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
Information on this site about identity standards, compliance frameworks or security architecture is provided for general information. It is not legal, regulatory or security advice, and it does not guarantee that any particular deployment will satisfy an audit or a regulator.
9. Limitation of liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.
Subject to that, we are not liable for indirect or consequential loss, loss of profit, revenue, business, goodwill or data arising from use of this site or any evaluation access. Our total aggregate liability arising from your use of the site is limited to AUD $100,000.
10. Indemnity
This clause applies only if we grant you demo, trial or evaluation access. It does not apply to ordinary use of this website.
You will indemnify Automentic, and its officers and employees, against third-party claims, and against reasonable legal costs, to the extent those claims arise from:
(a) your breach of section 4 (acceptable use);
(b) personal data, regulated data or live production data you process in an evaluation environment without a signed Data Processing Agreement; or
(c) content you submit that infringes a third party’s rights or is unlawful.
Indemnity does not apply to the extent a claim is caused by our negligence, wilful misconduct, or a defect in the site or evaluation environment. It does not limit any right or remedy that cannot be excluded under the Australian Consumer Law.
11. Changes to these terms
We may update these terms. The date at the top shows when. Continued use after a change means you accept the updated terms.
12. Governing law and and Disputes
These terms are governed by the laws of Western Australia, Australia.
If you are using the site or evaluation access in the course of a business, the courts of Western Australia have exclusive jurisdiction over any dispute arising from these terms.
If you are a consumer within the meaning of the Australian Consumer Law, nothing in these terms limits your rights under that Law. You may bring a claim in the courts of Western Australia or in the courts of your Australian state or territory. These terms do not exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded.
If you access the site from outside Australia, you do so on your own initiative. We make no representation that the site is appropriate or available for use in every jurisdiction.
